East African Legislative Assembly, Arusha, May 30, 2014: The much anticipated EAC Budget Speech shall now take place on Tuesday, June 3, 2014.  This follows adjournment of the House this afternoon by the Speaker, Rt. Hon Margaret Nantongo Zziwa.

Prior to the adjournment, Members had made submissions on the need to re-introduce the Motion to begin proceedings to remove the Speaker, which was suspended when the House adjourned Sine Die on April 3, 2014.  The matter was not part of the business on the Order Paper today.

Earlier this morning, the East African Court of Justice (EACJ) in its ruling of the consolidated Interlocutory Applications, declined to grant the interim orders sought by the applicants, Mbidde Foundation Ltd (1st Applicant) vs Secretary General and the Attorney General of the Republic of Uganda and the Speaker, Rt. Hon Margaret Nantongo Zziwa (Second Applicant) vs the Secretary General of the East African Community on the matter.

A three-Judges bench consisting of Principal Judge Jean Bosco Butasi, Deputy Principal Judge Isaac Lenaola and Judge Monica Mugenyi, declined to grant the interim orders restraining the debate on the removal of the Speaker.

 Among other things, the Court ruled that the consolidated applications lacked merit as no prima facie case with a likelihood of success was established by the Applicants (the Applicants pleadings that EALA has no Rules of Procedure, that the Respondents did not seek an Advisory Opinion of the Court and that once proceedings begin, there is likelihood of bias were not proven by the Applicants on whom the burden of proof lay).

When the House resumed today, EALA Member, Hon Peter Mathuki stood on a procedural matter and sort to have the matter re-introduced citing public interest as stipulated by Article 31 of the Rules of Procedure.
The Court came out clearly this morning on the matter and I indulge the House that we should resume with the proceedings first by revising the Order Paper to include the Motion, the legislator said.

Hon Abubakar Zein urged the House to protect its integrity saying that EALA needed to be on the right side of history and to keep true to Parliamentary traditions.  He said it was important for the Rules of the House to be followed to the latter.

When sought for clarification, the Counsel to the Community, Hon Wilbert Kaahwa maintained that EALA could proceed with its business on the basis of its Rules of Procedure unrestrained including the handling of the Motion for the removal of the Speaker.

Hon Dora Byamukama reiterated the need to observe the advice of the Counsel to the Community which she maintained was anchored under Article 69 of the Treaty for the Establishment of the East African Community.   Hon Christophe Bazivamo, Hon Patricia Hajabakiga and Hon Joseph Kiangoi supported the sentiments.

Hon Susan Nakawuki and Hon Fred Mukasa Mbidde however opposed the debate.  In her submissions, Hon Nakawuki informed the House that the EACJ had only disposed the interim application but was yet to pronounce itself on the main reference. She said that the matter at hand, the EAC Budget Speech, was significant and of considerable interest to the region.

Hon Mukasa Mbidde on his part noted that items of business on the Order Paper were a preserve of the Speaker. He remarked that the Court needed its due time to determine the main reference.
The House then remained suspended for twenty minutes to pave way for further consultation between the Speaker and the Council of Ministers.

The House is now expected to resume on Tuesday, June 3, 2014 at 10.00 am.

REPUBLIC OF BURUNDI SUED BY A CITIZEN OVER LAND DISPUTE

East African Court of Justice Arusha, 23 May 2014: The First Instance Division today heard a matter filed by   a Burundi Citizen Mr. Masenge Venant (Applicant) against the Attorney General of the Republic of Burundi (Respondent) seeking declarations from the Court that the acquiring and using of land property of Kizina by the government of Burundi is an infringement of Article 6 (d) and 7 (2) of the Treaty for Establishment of the East African Community.

The Applicant also seeks Court to declare that the failure by the Ministry of Foreign Affairs Burundi to demolish the buildings and stop construction from the land was unlawful and a violation of the Treaty for the establishment of the East African Community.

Mr. Ncutiyumuheto Lawyer for the Applicant submitted that, the Court has jurisdiction to entertain the matter under Article 27 of the Treaty. He also said the Applicant has the full right to enjoy his property that has been acquired by the State and therefore asked Court to order the government to demolish the buildings in his property.

He further submitted that although there is a same case still pending in the National Court in Burundi (Administrative Court) to bring a matter to this Court (EACJ) does not require exhausting of local remedies according to Article 30 of the Treaty as a Natural person. He therefore asked Court to grant the declarations sought.

Mr. Elisha Mwansasu Senior State Attorney representing the Republic of Burundi submitted to Court that the declarations being sought by the Applicant are not true because the land property belongs to the government and it is using it to construct schools as well as a National Centre for Agriculture Research. He also argued that Mr. Masenge alleged land ownership is illegal.

The Court will deliver its judgment on notice .Earlier the Court heard an application by the Applicant seeking an injunction to restrain the Government of Burundi from constructing on the land pending the final judgment and the ruling will be delivered on 19th June, 2014.

The East African Court of Justice (EACJ or ‘the Court’), is one of the organs of the East African Community established under Article 9 of the Treaty for the Establishment of the East African Community. Established in November 2001, the Court’s major responsibility is to ensure the adherence to law in the interpretation and application of and compliance with the EAC Treaty.

Arusha is the temporary seat of the Court until the Summit determines its permanent seat. The Court has the Sub-Registries in the Partner States’ National Courts. Article 6 (d) provides that good governance including adherence to the principles of democracy, the rule of law, accountability, transparency, social justice, equal opportunities, gender equality, a s well a s the recognition, promotion and protect ion of human and peoples right s in accordance with the provisions of the African Charter on Human and Peoples’ Rights;

Article 7 (2)The Partner States under take to abide by the principles of good governance, including adherence to the principles of democracy, the rule of law, social justice and the maintenance of universally accepted standards of human rights.

Mkuu wa wilaya Hai,Novatus Makunga amewaagiza viongozi wa vijijji na vitongoji vinavyopitiwa na barabara ya Machine Tools hadi Machame kuanza kutekeleza sheria ya barabara  katika kudhibiti uswagaji wa mifugo hususani ng’ombe katika barabara hiyo .


Mkuu huyo wa wilaya ametoa agizo hilo baada ya kukagua barabara hiyo ambayo ilikarabatiwa kwa kipande cha kilometa 7.9 na Wakala wa barabara nchini,Tanroads na baadaye alikagua barabara nyingine ya Kwasadala hadi Masama inayoendelea kujengwa na wakala huyo.


Akizungumza na viongozi mbalimbali wa vijiji vya kata ya Machame Kaskazini ambapo barabara hiyo imepita,aliwaeleza kuwa ni vyema  sasa wakaanza kusimamia sheria inayozuia mifugo kutembezwa barabarani badala ya wao kama viongozi kuanza kulalamika.


Viongozi hao awali walimweleza mkuu huyo wa wilaya kwamba kwa asili eneo la Machame siyo la ufugaji wa mifugo inayochungwa bali ufugaji wao ni ule wa ndani,hata hivyo limezuka wimbi la wamiliki wa Mabucha kwenda minadani na kununua ng’ombe ambao katika kuwasafirisha uamua kuwachunga barabarani na hivyo kuchangia uharibifu.


Makunga amemwagiza Kaimu meneja wa wakala wa Barabara,Tanroads mkoani Kilimanjaro Mhandisi Reginald Massawe kuandaa semina ya uelewa kwa viongozi wa vjiji na vitongoji itakayolenga kuwaelimisha sheria ya hifadhi ya barabara pamoja na mpango wa kuisimamia na kuwapa nakala ya sheria hiyo ili waanze mara moja kuitekeleza.


Amewataka viongozi hao kutoa notisi kwa wamiliki wa mabucha kuhusiana na kuanza utekelezaji wa sheria hiyo kwa lengo la kuwafahamisha kwamba kuanzia sasa watalazimika kusafirisha mifugo yao kwa njia ya barabara na ni marufuku kuswaga mifugo barabarani.


Kadhalika amewataka kushirikiana na wakala wa barabara kuwaondoa wote waliovamia maeneo ya hifadhi za barabara wakiwemo wanaondesha kilimo cha majani ya mifugo na wafanyabiashara wanaohifadhi mchanga wa ujenzi kwa kuwapa notisi kama sheria inavyotaka mapema iwezekanavyo.


Katika hatua nyingine Mkuu huyo wa wilaya amemtaka Mhandisi Massawe kutuma wataalamu watakaoianisha mapungufu mbalimbali ambayo yamejitokza katika ukarabati huo wa baabara yakiwemo ya baadhi ya maeneo kutokuwa na makalvati,mikondo ya maji kutokuelekezwa kwa usahihi,baadhi ya maeneo lami kuanza kumeguka pamoja na mahitaji ya  kuweka alama za kuvuka kwa waenda kwa miguu jirani ni makanisa,misikiti na shule.


Awali mhandsi Massawe ameeleza wakala wa barabara imetumia kiasi cha shilingi milioni 1,005 kukarabati sehemu ya kilometa 7.95 ya barabara hiyo yenye urefu wa kilometa 14.98.Amesema kazi zilzofanyika ni pamoja na kuondoa tabaka la lami,kuvuruga msingi wa awali,kujenga msingi mpya nakuweka tabaka jipya la lami nyepesi kwa upana wa barabara wa mita 9.0.


Amesema kuwa dosari mbalimbali zilzojitokeza ambazo walizibaini katika ziara hiyo ya mkuu wa wilaya ambazo znahtaji fedha nyingi zitafanyiwa kazi katika awamu ijayo ya kukarabati barabara hiyo ambayo itaingizwa katika mwaka ujao wa fedha ambao unaanza mwezi Julai huku ndogo ndogo wakianza kuzirekebisha mara moja.


Amesema kuwa katika mwaka ujao wa fedha kiasi cha shilingi milioni 800 zimetengwa kwa kazi ya kupanua mabega ya barabara kila upande na kujenga tabaka la lami nyepesi sehemu ya barabara yenye urefu wa kilometa 5.


Akiwa  katika barabara ya Kwasadala hadi Masama mkuu huyo wa wilaya amemtaka mkandarasi kushirikiana na viongozi wa eneo hilo katika kuhakikisha ujenzi wa makalvati ya kupitisha maji unakwenda kwa usahihi kwa lengo la kuepuesha madhara hasa nyakati za masika.


Aidha amemkatmkandarasi hiyo kutatua tatizo la baadhi ya maeneo kushindwa kupiika kutokana mvua znazonyesha sasa kwa kumwaga vifusi hasa katika maeneo yenye miteremko mikali.


Mkandarasi mpya wa barabara hiyo kampuni ya Hari Singh and Sons Limited ameahidi kurekebisha sehemu zote korofi katika kipindi hiki cha mvua wakati kazi ya ujenzi huo ambayo imefikia asilimi tano ikiwa inaendelea.


Mkandarasi huyo alianza kazi mwezi Januari mwaka huu baada ya kuvunjwa kwa mkataba wa mkandarasi wa awali katika barabara hiyo ambayo ni ahadi ya rais Jakaya Kikwete.

Utekelezaji wa mradi huo upo katika hatua za awali ambapo ujenzi wa njia yamchepuko ikiwa ni maandalizi ya ujenzi wa daraja la mto Namwi pamoja na ujenzi wa tabaka la kwanza la mawe yaliyosagwa unaendelea katika eneo lenye urefu wa kilometa 2


Ujenzi wa barabara hiyo yenye urefu wa Kilometa 12.5 unatarajiwa kukamilika mwezi Januari Mwakani.

Mnano Mwaka 2009 serikali wilayani Hai ilianza mchakato huo wa kuwa na shule za sekondari zenye kidato cha tano na sita
za wananchi.

Hali hiyo ilitokana na ukweli kwamba wilaya ya Hai ina shule za sekondari 45 ambapo kati ya hizo 29 ni za serikali na 16 siyo za serikali.

Kati ya shule 29 za serikali ni shule mbili tu yaani ya Lyamungo kwa wavulana na Machame kwa wasichana ndizo zenye kidato cha tano na sita.

Kikao kilichobuni uanzishaji wa Kamati ya Harambee ya ya kuchangia upanuzi wa shule za sekondari za wananchi Wilayani Haikilichofanyika mnamo Oktoba,2009 ofisini kwa mkuu wa wilaya.

HALI YA UJUMLA WA MRADI
1.LYASIKIKA SEKONDARI
        Shule hii imepokea shilingi 15,000,000/= tu kati ya makisio ya shilingi 30,000,000/= ili kujenga bweni la wanafunzi 48.
        Jengo limefikia hatua ya upanuzi na limekwisha wekewa bati na baadhi ya madirisha yamewekewa fremu za chuma.Sakafu ya jengo haijakamilika bado ni upangaji wa mawe ndani ya msingi
2.HARAMBEE SEKONDARI
     Shule hii imepokea shilingi 15,000,000/= kwa ajili ya ujenzi wa madarasa 3 na vyoo vya wanafunzi.
         Shule ilipokea kutoka mfuko wa maendeleo ya elimu wilaya,shilingi 15,477,542/= kutoka fedha za miradi ya maendeleo(CDG) na shilingi 10,000,000/= kutoka KNCU.Jengo ni la ghorofa na bado kazi kubwa hazijafanyika.
3.NKOKASHU SEKONDARI
        Shule hii imepokea shilingi 15,000,000/= kati ya shilingi 60,000,000/= za ukarabati wa madarasa mawili ya kidato cha tano.Ukarabati wa madarasa 2,Chumba cha matumizi ya maktaba na ofisi ndogo ya walimu pamoja na kujenga baraza na kubadilisha mabati chakavu eneo la paa la baraza na kubadilisha baadhi ya madirisha kuwa ya chuma kwa baadhi ya madarasa
4.LEMIRA SEKONDARI
      Shule hii imepokea shilingi 25,500,000/= kwa lengo la kumalizia ujenzi wa madarasa 3 na ujenzi wa hostel 2.Kulingana na makisio ya shilingi 75,000,000/=,Mfuko wa maendeleo ya elimu uliahidi kutoa asilimia 75 ya gharama zote kulingana na makisio ya ujenzi.Kazi ya ukamilishaji wa madarasa 3 imekamilika na yanaweza kutumika.

       Kazi zilizofanyika ni kuweka ceilingi board,vioo vya madirisha,ujenzi wa baraza yake na sakafu yake na kupiga rangi madarasa yote.Hostel ya wasichana bado ipo katika hatua za msingi na hakuna kazi inayoendelea.kuna vifaa kama tofali 100 na mchanga lori moja.
       Hosteli ya wavulana imefikia hatua ya lenta na hakuna kazi     
       inayoendelea.
5.HAI DAY SEKONDARI
      Mradi wa ujenzi wa vyumba 8 vya madarasa na matundu 16  ya vyoo jumla ya gharama shilingi 321,000,000.Kazi zote zipo katika hatua ya mwisho na mkandarasi amesalipwa shilingi 178,176,587.50

HITIMISHO
     Taarifa ya kina ya harambee hiyo ya upanuzi wa shule za sekondari kidato cha tano na sita wilayani Hai ilishasambazwa kwa waheshimiwa madiwani. 

    Wilaya imeandaa kikao cha wadau wa elimu ambacho kitafanyika katika wiki ya kwanza ya mwezi Ujao wa Juni ambapo taarifa ya mradi huu yenye kurasa zaidi ya mia moja itajadiliwa kwa kina pamoja na kuwasilisha mkakati wa kukamilisha shule hizo pamoja na maendeleo ya elimu kwa ujumla wake katika wilaya ya Hai
